1. Acceptance of Terms

By creating an account or using BuyShareLocal, you agree to these Terms of Service. If you do not agree, please do not use the platform.

2. Eligibility

You must be at least 18 years old to use BuyShareLocal. By using the platform, you represent and warrant that you are 18 years of age or older. We do not knowingly collect information from individuals under 18.

BuyShareLocal is currently available only to users in the United States.

3. Prohibited Items and Conduct

You may NOT list, sell, or exchange the following items on BuyShareLocal:

• Weapons, firearms, ammunition, or explosives
• Illegal drugs, controlled substances, or drug paraphernalia
• Alcohol or tobacco products
• Prescription medications or medical devices
• Stolen goods or counterfeit items
• Recalled products or items that violate safety regulations
• Live animals (except rehoming with proper documentation)
• Adult content, pornography, or sexually explicit material
• Items that infringe intellectual property rights
• Hazardous materials or chemicals
• Any item that violates local, state, or federal law

You also agree NOT to:

• Post fraudulent, misleading, or deceptive listings
• Harass, threaten, or abuse other members
• Use the platform for any unlawful purpose
• Spam or send unsolicited messages
• Impersonate another person or entity
• Attempt to hack, disrupt, or compromise platform security
• Scrape or collect user data without permission

4. User Content and Photos

You retain ownership of content you post (listings, photos, descriptions, messages). By posting, you grant BuyShareLocal a non-exclusive, worldwide, royalty-free license to display, store, and transmit that content to members of your community for the purpose of operating the platform.

You are responsible for ensuring your content does not infringe on third-party rights. This includes copyright, trademark, privacy, and publicity rights. You represent and warrant that you own or have permission to use all content you post.

We reserve the right to remove any content that violates these Terms or applicable law, without notice.

5. DMCA Copyright Policy

If you believe content on BuyShareLocal infringes your copyright, please send a DMCA takedown notice to legal@buysharelocal.com with the following information:

• Description of the copyrighted work you claim has been infringed
• URL or location of the infringing content on our platform
• Your contact information (name, address, email, phone)
• A statement that you have a good faith belief the use is not authorized
• A statement that the information is accurate and you are authorized to act on behalf of the copyright owner
• Your physical or electronic signature

We will respond to valid DMCA notices in accordance with the Digital Millennium Copyright Act.

6. Messaging and Communications

BuyShareLocal provides messaging functionality to facilitate transactions between members. Messages are stored on our servers and may be accessed by platform administrators for safety, security, and moderation purposes.

Do not share sensitive personal information (credit card numbers, social security numbers, passwords) via messages. We are not responsible for information you choose to share with other users.

You may report inappropriate messages using the report feature. We reserve the right to review reported messages and take appropriate action.

7. Community Membership and Admin Powers

Access to a community is controlled by the community admin. Admins may approve, reject, ban, or remove members at their discretion. BuyShareLocal is not responsible for decisions made by community admins.

Community admins have the ability to:

• Approve or reject membership requests
• Ban or remove members from the community
• View member email addresses and profile information
• Remove listings that violate community rules
• Access reported messages for moderation purposes

8. Listings and Transactions

BuyShareLocal facilitates connections between neighbors but is not a party to any transaction. All exchanges — including payment, pickup, delivery, and condition of items — are the sole responsibility of the buyer and seller.

We do not:

• Process payments or handle money
• Verify the accuracy of listings
• Guarantee item quality, condition, or authenticity
• Mediate disputes between buyers and sellers
• Provide refunds or compensation for failed transactions

You are responsible for: verifying item condition before purchase, arranging safe pickup/delivery, handling payment directly with the other party, and complying with all applicable tax laws (including reporting income to the IRS if required).

9. Account Termination and Banning

We reserve the right to suspend or terminate accounts that violate these Terms, at our sole discretion, with or without notice. Reasons for termination may include (but are not limited to):

• Posting prohibited items
• Fraudulent or deceptive behavior
• Harassment or abuse of other members
• Violation of applicable laws
• Multiple community bans

If your account is terminated, you may not create a new account without our permission. You may contact us to appeal a termination decision.

You may delete your account at any time by contacting support@buysharelocal.com. Upon deletion, your listings, messages, and personal information will be removed from our systems (subject to legal retention requirements).

You agree to indemnify, defend, and hold harmless BuyShareLocal, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorney fees) arising from:

• Your use of the platform
• Your violation of these Terms
• Your violation of any law or third-party rights
• Content you post on the platform
• Transactions you conduct with other users

12. Dispute Resolution and Arbitration

Any dispute arising from these Terms or your use of BuyShareLocal shall be resolved through binding arbitration, rather than in court, except that you may assert claims in small claims court if your claims qualify.

The arbitration will be conducted by the American Arbitration Association (AAA) under its rules. The arbitrator's decision will be final and binding.

You agree to waive your right to participate in a class action lawsuit or class-wide arbitration. All disputes must be brought on an individual basis.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions.

14. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by email or through the platform. Continued use of the platform after changes constitutes acceptance of the updated Terms.

The "Last updated" date at the top of this page indicates when these Terms were last revised.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
